1. Service Overview
ClicNode (hereinafter “the Service”) is an AI-powered website builder and business platform accessible at www.clicnode.com. The Service is provided as software-as-a-service (SaaS) by ClicNode, established in Geneva, Switzerland.
2. Acceptance of Terms
By creating an account or using the Service, you agree to be bound by these Terms of Service in full. If you do not agree to these terms, you must not access or use the Service.
3. User Account
- One account per individual or legal entity. Shared accounts are prohibited.
- You are responsible for keeping your credentials confidential and for all activity occurring under your account.
- You must notify us immediately at support@clicnode.com in the event of any unauthorised access.
- You must be at least 16 years old to create an account.
4. Acceptable Use
You may not use the Service to:
- Publish, store, or distribute any unlawful, defamatory, obscene, hateful, or rights-infringing content.
- Send unsolicited communications (spam), phishing attempts, or any form of fraudulent activity.
- Automatically extract data from the Service (scraping) without prior written permission.
- Attempt to bypass security controls or access third-party data.
- Violate any applicable law or regulation.
ClicNode reserves the right to remove any violating content without prior notice.
5. AI-Generated Content and Intellectual Property
Websites and content generated by AI from your instructions belong to you. ClicNode claims no intellectual property rights over the content you create through the Service.
By using the Service, you grant ClicNode a limited, non-exclusive, revocable licence to host, store, and serve your content solely for the purpose of providing the Service to you.
You warrant that any content you submit does not infringe third-party intellectual property rights. Any infringement claim shall remain your sole responsibility.
6. Subscriptions and Billing
- The Service is offered as a monthly or annual subscription. Current rates are published on the Pricing page.
- Subscriptions renew automatically at the end of each billing cycle unless cancelled prior to the renewal date.
- You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period; no pro-rata refund is granted for unused time unless required by mandatory law.
- Payments are processed via Stripe. In the event of payment failure, we will notify you and provide a 7-day grace period to update your payment method before account suspension.
7. Limitation of Liability
The Service is provided “as is” without warranty of uninterrupted availability or error-free operation. ClicNode uses commercially reasonable efforts to maintain Service continuity but cannot guarantee 100% uptime.
To the fullest extent permitted by Swiss law, ClicNode's aggregate liability to you for any claim arising out of or relating to the Service is limited to the fees paid by you in the month preceding the event giving rise to liability. ClicNode disclaims all liability for indirect damages, data loss, lost profits, or business interruption.
8. Termination
By you: you may delete your account at any time from Settings. Account deletion triggers permanent erasure of your personal data within the timeframes set out in our Privacy Policy.
By ClicNode: we reserve the right to suspend or terminate your account in case of breach of these Terms, with prior notice whenever practicable except in emergencies (fraud, security threats).
9. Changes to These Terms
ClicNode may update these Terms of Service. For material changes, we will notify you by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated terms.
10. Governing Law and Jurisdiction
These Terms are governed by substantive Swiss law, excluding conflict-of-law rules. Any dispute shall be submitted to the exclusive jurisdiction of the courts of the Canton of Geneva, Switzerland, without prejudice to mandatory consumer protection provisions in your country of residence.
